Anvil action dismissed

MONTREAL, Feb 2 – A class action against Australian copper producer Anvil Mining over a 2004 massacre that occurred in the town of Kilwa in the Democratic Republic of Congo has been thrown out in a Canadian court.
A survivors group, the Canadian Association Against Impunity, began court action in Quebec in 2010 accusing the miner of providing logistical support to Congolese army troops responsible for rapes and murders in the northeast of Katanga Province.
CAAI says United Nations investigations showed 70 people died as a direct result of the military action, including some who were executed and thrown into mass graves.
The Quebec Superior Court ruled last April the case could be heard in the Quebec jurisdiction, rejecting Anvil Mining’s argument that it had no jurisdiction in the case.
The company says the province’s Court of Appeal, in a unanimous decision on January 24, reversed the Superior Court judgment and dismissed the proceedings.
Anvil Mining argues the Kilwa incident and the company have been the subject of several investigations and court proceedings in and outside the DRC before the Quebec proceedings were initiated.
